TERMS & CONDITIONS FOR PARTICIPATION AT MAYA BAZAAR
Please Note: Maya Bazaar intends to be a safe-space for everyone. We exercise zero- tolerance to violence, abuse, and exploitation (sexual, physical or otherwise). Any person(s) found in violation will be removed from the premises immediately and further action will be initiated.
1. CONTRACTING PARTIES
1.1. These terms and conditions bind the Signing Party who filled the form (hereafter referred to as Applicant) with Maya Bazaar and Road to Utopia (hereafter referred to as Organizers) in a mutually enforceable contract.
1.2. The submission of stall registration form by any authorised person of the Applicant Company shall itself be deemed as confirmation of participation and acceptance of these terms of contract. The Applicant shall be presumed to have read the terms and conditions and irrevocably agreed to abide by them.
1.3. The terms and conditions are applicable to each and every Applicant, irrespective of the amount or percentage of payment made to the Organizers, and includes co-Applicants as well as companies/organisations of Complimentary Stalls, irrespective of whether or not they have signed the application form or any other document.
2. TIMINGS, ADMISSIONS & SPACE ALLOCATION
2.1. Timings and access shall be decided solely by the Organizers, who will specify business hours, set up time, access permissions, etc.
2.2. Admission to the Market shall be by ticket or Identification Badge. Each Applicant will be provided a certain fixed number of Identification Badges as decided by the Organizers. All Applicants and their team members should wear the provided Identification Badges at all times inside the venue. Identification Badges shall not be transferable.
2.2. The Organisers reserve rights to allocate stalls in any manner they deem fit and their decisions shall be final. The Organizers are also entitled, at their absolute discretion, to change, withdraw, or otherwise deal with allotted spaces.
2.4. No business activity shall be conducted by the Applicant, and/or their staff, outside the space allocated to them.
2.5. The Applicant’s property and products may be brought to, displayed, stored at, and removed from the Market venue at the Applicant’s own risk, and the Applicant is responsible for the safety of its property at all times.
2.6. No Applicant shall assign or subcontract their allocated space, or any part thereof.
2.8. The Applicants and the Organizers may use their respective business logos together, for the purposes of promotion of the Market.
3. LIABILITIES & CONTINGENCIES
3.1. The Applicant agrees to indemnify the Organizers against any claims, demands, proceedings, damages, or liabilities due to: i. any breach of these terms and conditions, ii. any violation of applicable laws and regulations, iii. any act, omission, default, negligence, loss or damage caused, by the Applicant, in connection with any other person/s, the Market or the Organizers.
3.2. Organisers are not responsible, and shall bear no liability, for any commercial transactions conducted by Applicants with the customers, or for tax liabilities of Applicants with concerned authorities.
3.3. Failure of the Applicant at any time, before or during the event, to comply with any of the terms and conditions shall automatically deprive them of the right to participate any further in the Market. No claim for refund of any fee paid shall be entertained.
3.4. The Organisers reserve rights to change the dates/venue of the exhibition even if such matters have been confirmed, and in such circumstances, the contract between the Organizers and the Applicant shall continue to bind the parties as appropriate.
3.5. Force Majeure- In case the Market has to be cancelled at location or shut down early for whatsoever reason (Example- COVID related reasons) beyond the control of the Organizers, performance under this contract shall be absolutely discharged and the Organizers shall not be liable to refund any rental payments and shall not be liable for any losses, damages, demands, costs, claims, charges, or other expenses of any kind, howsoever arising in respect thereof. Applicants should insure for any such events occurring
4. INTERPRETATION & DISPUTE RESOLUTION
4.1. The Organisers reserve the right to alter and amend any of the terms and conditions, and the Organizers' interpretation of these shall be final and binding on all parties, in case of any ambiguity, dispute or difference.
4.2. Any changes to these terms and conditions, to hold good, must be made in writing, approved and duly signed by an authorised official of the Organizers.
4.3. Any grievances by Applicants may be raised with the Organizers at first instance, and a good faith negotiation shall be made to arrive at a mutually agreeable solution.
4.4. This contract shall be governed by and construed according to the laws applicable in India. Any disputes between the parties under this agreement shall be submitted to the jurisdiction of courts of law in Bengaluru, Karnataka.
